PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE WEBSITE AND ITS SERVICES.
Introduction
Snow Recruiter d.o.o., buisness address at Gorazdova ulica 19, Ljubljana, Slovenia, registration number: SI83919139 (referred to as “Snow Recruiter”, “we”, “us” or “ours”) is an operator of Snow Recruiter online platform (referred to as “online platform”, “website” or “portal”) for snowsports instructors (referred to as “instructors”) and snowsports schools (referred to as “schools”) available at www.snow-recruiter.com and www.snow-recruiter.com.
These terms and conditions govern your use of this website and of the portal; by using this website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website.
You must be at least 16 years of age to use the portal and our services. By using this website and by agreeing to these terms and conditions you warrant and represent that you are at least 16 years of age.
This website uses cookies. By using this website and agreeing to these terms and conditions, you consent to our Snow Recruiter's use of cookies in accordance with the terms of Snow Recruiter's privacy policy.
Membership
We restrict a registration of profile account and obtaining membership to instructors and schools. In order to use the content and or services of website a registration and creation of a profile account is obligatory.
Unregistered visitors can not access Instructor’s uploaded personal information such as your last name, e-mail address, telephone number and uploaded documents.
Upon completing the registration and obtaining a profile account you have become a member of Snow Recruiter and are entitled to use our Services.
Your basic membership will automatically renew itself after one year. You can deactivate your membership at any time (with no refunds) on Profile settings. You can permanently delete your account at any time (with no refunds) by sending us an e-mail to info(at)snow-recruiter.com. This Agreement will govern your relationship with us and your use of our services during the duration of your membership.
Services for members include hosting member’s profiles, connecting them to the other members, in some cases giving them a direct communication channel, hosting the platform for posting, searching, applying to jobs, sending e-mails and notifications about new opportunities and products that are in close connection to snow sports a few times a week, unless Opting-out in Profile settings. Members will get an e-mail for any personal notification on their profile.
By registering your snowsports school on our portal, you agree to the use of your schools logo and social media (Google+, Facebook, Instagram, LinkedIn or any other) content for the use of further marketing of your school’s job posts through Snow Recruiter’s social media accounts and other marketing services (Google ads, etc.).
Types of membership
Basic membership is free of charge profile account for instructors or for schools (bronze package). Profile account of all members with basic membership is published on the website.
A Published user is a profile account for anyone who registers and provides all the required information.
An Unpublished user is a profile account for anyone who has started the registration but failed to provide all the required information. Unpublished users can not apply to jobs and are not searchable in the Search engine. Unpublished schools can not open a job vacancy nor use all the functionalities of our Search engine.
The Customer is a school that purchases any packages or services from Snow Recruiter and is registered on the website.
INSTRUCTORS: In order for your profile account to be visible to other members and for you to be able to apply for jobs, you need to fill your profile with required information.
SCHOOLS: Your profile account will be available to all members if it is containing required information. You will be able to see the full profiles of members that apply to your job posting and contact them. You need to subscribe to one of our packages (silver or gold) if you wish to obtain information and contacts of all searchable users.
Payable member services
In addition to the basic membership, Customers can purchase additional packages or services that are payable. Payable services are non-refundable and the golden package will be renewed automatically unless Opted out in the Profile account settings (in this case the purchased service keeps working until it’s due).
Duration of the purchased services:
- Schools’ job posting: 45 days or the end date of the offered job position.
- Schools’ silver package: 30 days.
- Schools’ golden package: 365 days.
- Jobs’ pop to the top: until new job is published or another job gets “popped to the top”.
- Jobs’ graphical exposure: until the job post runs out (see “Schools’ job posting).
Payments methods
Upon choosing one of our paid services, you are presented with payment option and method (Stripe, Inc.) and you are asked to fill out the required missing billing information. If you buy any of our paid Services (packages or one-time services), you agree to pay us the applicable fees and taxes. Failure to pay these fees will result in the termination of your paid Services. Also, you agree that:
- Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates).
- Based on your chosen payment option we may store some information in order to continue billing you for your chosen Services.
- We may store some billing information in order to avoid interruptions in your Services and use this information for your next purchase on the web site.
- If you purchase a subscription, your payment option will be automatically charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, you can cancel the services in your Profile settings before the renewal date.
- We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.
- A copy of the invoice will be sent to the provided email address.
License to use the website
Unless otherwise stated, Snow Recruiter and/or our licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.
The website is meant for restricted use purposes only. Downloading and printing the content from the website is strictly forbidden.
You must not:
- republish material from this website (including republication on another website - unless with written agreement from Snow Recruiter’s legal representatives);
- sell, rent or sub-license material from the website;
- show any material from the website in public;
- reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
- redistribute material from this website (except for content specifically and expressly made available for redistribution: Published articles (“Tips for instructors”), Published job vacancies).
Unacceptable use
You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.
You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without Snow Recruiter's express written consent.
You must not use this website to transmit or send unsolicited commercial communications.
You must not use this website for any purpose related to marketing without Snow Recruiter's express written consent.
You must not publish jobs that are not real or that are not related to instructing snow sports.
Marketing for instructor’s training under the pretence of this being a snowsports instructor job is strictly forbidden.
If we suspect that you are participating in any of the above stated activities we may permanently delete your account without notice and pursue legal action against you.
Restricted access
Snow Recruiter reserves the right to restrict access to any areas of this website, or indeed this entire website, at Snow Recruiter discretion.
We reserve a right to demand a presentation of certificate from any user to verify their qualification as a snowsports instructor. In case of failure of user to present a certificate, we reserve a right to delete user’s account on website due to violation of these Terms and conditions.
You must ensure that your registration e-mail and password are kept confidential.
Snow Recruiter may disable your profile account and password in Snow Recruiter's sole discretion without notice or explanation.
Member content
In these terms and conditions, “your member content” means material (including text without limitation, personal information, contact information, images, video material and audio-visual material, uploaded documents, your certification and availability information and all other information) that you submit to this website, for whatever purpose.
Registered instructors and schools grant for the accuracy and ownership of the uploaded data on their profiles.
You grant Snow Recruiter a worldwide, universal, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your member content in any existing or future media. You also grant Snow Recruiter the right to sub-license these rights, and the right to bring an action for infringement of these rights. This does not apply for your personal information.
Processing of your personal information is subject of our privacy policy.
Your member content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or Snow Recruiter or a third party (in each case under any applicable law).
You must not submit any member content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
All members can write comments, review instructors/schools and post other content on Snow Recruiter website or through other Snow Recruiter's online channels but we prohibit any insulting or hostile talk.
Snow Recruiter reserves the right to edit or remove any material submitted to this website, or stored on Snow Recruiter's servers, or hosted or published upon this website.
Notwithstanding Snow Recruiter's rights under these terms and conditions in relation to member content, Snow Recruiter does not undertake to monitor the submission of such content, or the publication of such content on this website.
Instructor’s profile account must contain the following true information for them to be searchable users:
- General info: Name, gender, year of birth, nationality, city of residence, years of experience.
- Competences: Snow sports you can teach, fields of work you are willing to teach, languages you can teach in.
- Certifications: level and issuing country of obtained snow sports instructors certification and scanned document that verifies it.
School’s profile account must contain the following true information for them to be considered as a member and to be able to add new job vacancies (payable) or subscribe to a package (payable) to get access to the full functionalities of the Search engine and get access to all registered instructors full profiles:
- Logo, location, snowsports, and fields of work the snowsports school offer.
Social networking services
By granting Snow Recruiter the access to any social network accounts (Google+, Facebook, LinkedIn or any other), you understand that Snow Recruiter will access, make available and store (if applicable) any text, graphics, images, music, audio, video, information or other materials that you have provided to and stored within your social network account so that it is available on and through the website and services via your Snow Recruiter account, unless otherwise specified in these Terms and conditions. Depending on the social network accounts you choose, and subject to the privacy settings that you have set in such social network accounts, personally identifiable information that you post to your social network accounts will be available on and through your Snow Recruiter account on the website and services. Please note that if a social network account or associated service becomes unavailable on Snow Recruiter or access to such a social network account is terminated by the third-party service provider, then the social network content will no longer be available on and through the Snow Recruiter portal and services.
Please note that your relationship with the third-party service providers associated with your social network accounts is governed solely by your agreement(s) with such third-party service providers.
No warranties
This website is provided “as is” without any representations or warranties, express or implied. Snow Recruiter makes no representations or warranties in relation to this website or the information and materials provided on this website (including but not limited to job vacancies, advertisements, promotions, etc.).
Without prejudice to the generality of the foregoing paragraph, Snow Recruiter does not warrant that:
- this website will be constantly available, or available at all; or
- the information on this website is complete, true, accurate or non-misleading.
Nothing on this website constitutes, or is meant to constitute, advice of any kind.
Limitations of liability
Snow Recruiter is not liable for any member content or anything in relation to or the use of, or otherwise in connection with, this website:
- for any direct loss; or
- for any indirect, special or consequential loss; or
- for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
These limitations of liability apply even if Snow Recruiter has been expressly advised of the potential loss.
Exceptions
Nothing in this disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Snow Recruiter's liability in respect of any:
- death or personal injury caused by Snow Recruiter's involvement;
- fraud or fraudulent misrepresentation on the part of Snow Recruiter; or
- matter which it would be illegal or unlawful for Snow Recruiter to exclude or limit, or to attempt or purport to exclude or limit, its liability.
Reasonableness
By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable.
If you do not think they are reasonable, you must not use this website.
Other parties
You accept that, as a limited liability entity, Snow Recruiter has an interest in limiting the personal liability of its representatives and employees. You agree that you will not bring any claim personally against Snow Recruiter representatives or employees in respect of any losses you suffer in connection with the website.
Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Snow Recruiter's representatives, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Snow Recruiter.
Unenforceable provisions
If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.
Indemnity
You hereby indemnify Snow Recruiter and undertake to keep Snow Recruiter indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Snow Recruiter to a third party in settlement of a claim or dispute on the advice of Snow Recruiter's legal advisers) incurred or suffered by Snow Recruiter arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
Breaches of these terms and conditions
Without prejudice to Snow Recruiter's other rights under these terms and conditions, if you breach these terms and conditions in any way, Snow Recruiter may take such action as Snow Recruiter deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
Variation
Snow Recruiter may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.
Assignment
Snow Recruiter may transfer, sub-contract or otherwise deal with Snow Recruiter's rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
Severability
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
Entire agreement
These terms and conditions, together with privacy policy, constitute the entire agreement between you and Snow Recruiter in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.
Law and jurisdiction
These terms and conditions will be governed by and construed in accordance with laws of Republic of Slovenia, and any disputes relating to these terms and conditions will be subject of the jurisdiction of the courts of Ljubljana.
